Whisky digital marketing within the rules

Digital channels are where whisky brands can talk about flavour, serves and craft in depth. They are also where it is easiest to break a rule by accident. This guide sets out the layers of rules and the habits that keep a team on the right side of them.

The starting point: restricted advertising

Direct advertising of alcohol is restricted in India. Promoting alcohol indirectly through brand extensions is also regulated. Online channels are not a loophole. A social post, a video or a paid placement is judged by the same tests as a television spot or a hoarding. State rules on promotion add another layer, because alcohol is largely a state subject.

Our guide to surrogate advertising rules for spirits covers the brand extension question in detail. This guide focuses on the everyday digital work around it. Rules change, so check the current codes and take legal advice for campaigns. This is not legal advice.

Age comes first, everywhere

The legal drinking age in India is set by each state and ranges from 18 to 25. Digital teams should design for the strictest age that applies wherever the content can be seen, which online usually means everywhere.

  • Age gates on brand websites ask visitors to confirm their date of birth before entering.
  • Audience settings on social platforms restrict who can follow or see content by age and location where the platform allows it.
  • Creative choices avoid anything that appeals mainly to young people: cartoon styles, school settings, youth slang. Many responsible marketing codes also ask that anyone shown drinking clearly looks over 25.

Platform rules sit on top of the law

Each social and search platform has its own policy on alcohol content and advertising. Policies differ by country and change often. Some platforms prohibit paid alcohol advertising in certain countries entirely. Others allow it only with age and location targeting. A post that is legal may still be removed by the platform, or the account restricted.

The practical habit is to check the platform policy for India before every paid campaign, not once a year. Screenshots of the policy on the day of launch are a useful record.

Influencers and disclosure

When a brand pays or gives products to an influencer, the post is advertising. ASCI's guidelines require influencers to disclose material connections with brands clearly, with a label the audience will notice. On top of disclosure, the same content rules apply: no appeal to people under the legal drinking age, no excessive drinking, no drinking and driving.

Choose influencers whose audience is overwhelmingly above the legal drinking age. Ask for audience data before signing. A food or travel creator whose followers skew young is the wrong partner, however good the content.

What good whisky content looks like

The content that works best for whisky online is also the safest. People want to understand what they drink. Content on how whisky is made, what a cask does, how to nose a dram, how to make a highball with plenty of ice and soda or how to pair whisky with food teaches something and invites no criticism.

Some lines never move: no suggestion that alcohol brings social, sexual or sporting success, no health claims, no drinking with driving, swimming or machinery, no encouragement to drink more or faster. Mentioning water, pacing and getting home safely sits well alongside any tasting content. Our guide to whisky sensory training for marketing teams helps teams write flavour content that is accurate.

Personal data needs care

Age gates, newsletter sign-ups, contests and event registrations all collect personal data. India's Digital Personal Data Protection Act of 2023 sets obligations on consent, purpose and security for personal data. Collect only what is needed, say clearly what it is for and keep it secure. Date of birth collected for an age gate should not quietly become a marketing database. Requirements under the Act are being phased in, so the legal team should confirm what applies at the time.

A simple pre-publish checklist

  1. Is the audience setting restricted by age and location?
  2. Would the content appeal mainly to people under 25?
  3. Does it suggest drinking brings success or link drinking with driving?
  4. Is any paid partnership clearly disclosed?
  5. Does it make any health claim?
  6. Does it comply with the platform's current policy for India?

Your first step

Open your brand's last 20 social posts and run each through the checklist above. Count how many pass all six questions. The ones that fail are your team's training brief, written by your own content.

Common questions

Can whisky brands advertise on social media in India?

Direct alcohol advertising is restricted in India and platforms add their own policies. Brands focus on age-gated, educational content and take legal advice for campaigns.

What is an age gate?

A screen on a brand website or app that asks visitors to confirm they are over the legal drinking age before entering.

Do influencers have to disclose paid whisky posts?

Yes. ASCI guidelines require clear disclosure of material connections. The content must also follow alcohol marketing rules.
