Tamil Nadu craft beer and microbrewery rules, as of October 2026

Tamil Nadu has never issued a microbrewery licence. Here is what the rules do allow, how TASMAC controls every bottle and keg and why the 2026 retail announcement is worth watching.

No microbrewery licence, plainly

Tamil Nadu has no microbrewery or brewpub licence. Beer manufacture runs under the Tamil Nadu Brewery Rules, 1983, written for large plants: an applicant submits a scheme to the government, gets a letter of indent and then a licence from the Commissioner of Prohibition and Excise (Tamil Nadu Brewery Rules, 1983). Nothing in them suits a 500 litre brewhouse behind a restaurant.

The idea has come up and gone quiet. In September 2018 a TASMAC official said a draft proposal for microbreweries had been initiated, likely starting with selected hotels and restaurants (DT Next, September 2018). By July 2019 the excise minister said the state had no plans to allow them (The Federal, July 2019). We found no later order, draft rules or Cabinet decision.

TASMAC controls supply

The Tamil Nadu State Marketing Corporation (TASMAC) holds wholesale and has run all retail since November 2003 (licensing guide, reviewed August 2026). Licensed hotels, clubs and bars buy their liquor from TASMAC outlets (The News Minute).

For a craft brand this is the whole route to market. Beer must be made at a licensed brewery, registered and listed with TASMAC, then bought by bars through TASMAC. There is no channel for a small producer to sell kegs to a bar directly.

How beer is taxed

Beer pays excise duty and VAT, collected through TASMAC. VAT is the larger share: in 2025-26 TASMAC raised ₹50,845 crore for the state, of which VAT was ₹39,010 crore and excise duty ₹11,836 crore, according to the 2026-27 policy note (DT Next). The last confirmed beer price rise came with an excise increase from 1 February 2024, ₹10 on a 650 ml bottle (Business Today, 30 January 2024). A further rise was under discussion in July 2026. We found no public per litre duty schedule for beer, so ask the department before you model a price.

Pouring draught without a brewery

On-trade licences are narrow. FL-2 covers non-proprietary clubs supplying members. FL-3 covers star hotels (fee schedule). The Licence and Permit Rules, 1981 include beer and draught beer in liquor and add a special privilege fee of 10% for draught beer sales in three, four and five star hotels (Licence and Permit Rules, 1981). A standalone pizzeria cannot simply apply for a bar licence the way it would in Karnataka or Telangana. In practice a restaurant that wants craft beer on tap in Tamil Nadu has no direct route today.

Where draught is poured, the kegs come from licensed breweries through TASMAC. A hotel that pours draught has to manage what the brewer cannot: every keg arrives on someone else's timeline, so line cleaning and cellar temperature decide whether the beer tastes as it should. Contract brewing

There is no contract-brewing licence. A brand owner can only have beer made at one of the state's licensed breweries under the 1983 rules and sold through TASMAC. Brewing in a neighbouring state brings its own permits and duties. Our contract brewing guide covers how those deals work.

The 2026 changes to watch

After the 2026 election the new government said it would hand TASMAC's retail shops, including bars, to private operators in corporations and municipalities, with amendments to the Prohibition and Excise Act to be tabled in the next Assembly session (DT Next, 29 July 2026). As of August 2026 this was an announcement, not law (licensing guide). It concerns retail. Nothing we found says microbreweries are part of it.

If retail opens, the next question is whether wholesale and manufacture follow. Founders should watch the bill text, not the headlines.
